Orbit Content Moderation Policy

INTRODUCTION & GUIDING PRINCIPLES
Orbit is dedicated to fostering a global, fair, and high-quality ecosystem for music, movies, and art. Our platform is built on the principles of creator empowerment, genuine ownership, and direct, transparent compensation. This Content Moderation Policy outlines the standards and rules for all content listed on the Orbit Platform.
Our moderation process is a shared responsibility, beginning with our Producer partners and Aggregator network. We aim to ensure that all content is legal, respectful of intellectual property, and contributes to a trusted environment for creators and consumers alike.

THE SHARED RESPONSIBILITY MODEL
Orbit's content integrity relies on a multi-layered approach to verification and accountability:
Layer 1: The Producer: The content creator or rights holder (the "Producer") is the first line of responsibility. By signing the Digital NFT Non-Exclusive Distribution Agreement, the Producer contractually declares and warrants that they own and/or control all necessary digital rights for the content they provide to the Platform.
Layer 2: The Aggregator: Our in-country Aggregator partners are responsible for sourcing and onboarding Producers. They are contractually obligated to verify the accuracy and legality of all content and Metadata submitted by the Producers they manage. Aggregators can be terminated for listing unauthorized or inappropriate content.
Layer 3: Orbit Platform Review: Orbit performs its own reviews and will take action on any content that violates this policy. Orbit remains the sole judge of the conditions under which Recordings are commercialized and reserves the right to remove content at its discretion.

PROHIBITED CONTENT
Content that falls into the following categories is strictly prohibited on the Orbit Platform. The submission of such content is a violation of our legal agreements.
3.1. Intellectual Property Infringement
Copyright Violation: Any audio, video, or artistic work for which the Producer does not own or control the necessary digital distribution rights. This includes unauthorized samples, remixes, or use of third-party visuals.
Trademark Infringement: Unauthorized use of brand names, logos, or other trademarks in a way that is likely to cause confusion. The Producer's right to use their own brand and label names is granted for promotional purposes.
Counterfeits: Content that is falsely presented as being created by a specific artist or brand when it is not.
3.2. Illegal and Harmful Content
Hate Speech: Content that promotes violence, incites hatred, promotes discrimination, or disparages on the basis of race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, sex, gender identity, or any other characteristic that is associated with systemic discrimination or marginalization.
Harassment and Cyberbullying: Content that targets private individuals with abusive or unwanted behavior.
Exploitation of Minors: Any content that endangers or exploits children is strictly forbidden and will be reported to law enforcement authorities.
Promotion of Illegal Acts: Content that encourages or provides instructions for dangerous or illegal activities, including but not limited to self-harm, violence, or criminal acts.
3.3. Technically Non-Compliant Content
Missing or Invalid ISRC: All music Recordings must be assigned a valid International Standard Recording Code (ISRC) before being listed on the Platform. This is the responsibility of the Producer and is verified by the Aggregator.
Inaccurate or Misleading Metadata: All submitted Metadata must be accurate and correctly identify the Recording, including artist names, titles, writers, and relevant codes (e.g., ISRC, EAN).
Geographically Restricted Content: Due to the borderless nature of blockchain technology, all content must have worldwide distribution permissions. Content with territorial restrictions cannot be listed.
3.4. Deceptive Content
Spam and Scams: Content primarily intended to deceive, defraud, or mislead users for financial or other gain.
Impersonation: Accounts or content that impersonates any person or entity in a deceptive manner.

ENFORCEMENT ACTIONS
Violations of this policy will result in one or more of the following enforcement actions, depending on the severity and frequency of the violation.
Content Removal: Orbit may immediately remove any Recordings or associated Metadata from the Platform without notice. Producers also have the ability to request the withdrawal of a Recording in the event of a legal claim.
Warning: For minor or first-time infractions, a formal warning may be issued to the responsible Aggregator and/or Producer.
Aggregator Agreement Termination: Orbit reserves the right to terminate its agreement with an Aggregator who is found to be onboarding bad or unauthorized content. In such cases, the Aggregator forfeits all outstanding commissions.
Producer Agreement Termination: Orbit may terminate the distribution agreement with a Producer for material breaches of their obligations, including repeated violations of this content policy.

REPORTING AND APPEALS
Users and rights holders who believe that content on the Orbit Platform violates this policy or infringes on their rights should contact us at support@orbit.channel.
Any claims made by a third-party will be forwarded to the responsible Producer within fifteen (15) working days. The Producer is obligated to indemnify and hold Orbit harmless from any claims arising from the unauthorized use of rights.
Aggregators or Producers who believe an enforcement action was taken in error may appeal the decision by contacting their Orbit representative or the legal contact address above.
